1. Using a Saturday Edition for Rural Areas

The Department of Labor (DOL) requires that an employer advertise on two different Sundays in a newspaper of general circulation for the area of intended employment. In most cases, it is easy to find a major paper that publishes a Sunday edition.

In rural areas, however, this can sometimes pose a problem. The DOL therefore makes an exception to the Sunday requirement for rural areas where there is no newspaper with a Sunday edition. In such cases, the employer may choose the newspaper with the widest circulation for that location. For instance, in the rural area of Winchester, VA, the Winchester Star would be considered the paper with the widest circulation, even though it does not publish on Sunday.

This exception applies only to rural areas. The DOL FAQs state: "If a suburban newspaper has no Sunday edition, the employer must publish the Sunday advertisement in the most appropriate city newspaper that serves the suburban area." For example, the Jersey Journal, which does not publish on Sunday, has the greatest circulation figures for Jersey City in Hudson County, NJ. But because Jersey City is located in the Newark metro area, the Sunday edition of the Newark Star-Ledger would serve as the newspaper of general circulation for that area.

This is a critical distinction that can help ensure that your ads are run in the appropriate publication according to the DOL requirements.


2. Placing New York Job Orders on America's Job Exchange (AJE)

The Department of Labor (DOL) requires that employers place their job orders through the State Workforce Agency (SWA) in the area of intended employment. Some SWAs may use America’s Job Exchange (AJE) to post job orders, as opposed to a separate state-hosted site like EmployFlorida.com or WorkInTexas.com. As long as the employer is working through the SWA to post it, a job order posted on AJE is acceptable.

The New York DOL has a special agreement with AJE through which AJE hosts the official New York Job Exchange site, used to place NY SWA job orders. In order to submit a job order directly to the NY DOL for processing, a company must have an Unemployment Insurance Number (UIN). While this is the preferred method for posting NY job orders since it most clearly complies with the DOL requirement of working through the SWA, some clients elect to post the job directly to NY’s AJE affiliate site. Posting directly to AJE is done at the discretion of the attorney or client, and can be done by registering through www.americasjobexchange.com/ny and not through the main AJE registration page.

In all cases where AJE is used to post a job order, the employer may not also use AJE to satisfy one of the three additional recruitment methods for professional positions.


3. Indiana State Workforce Agency (SWA) Revises Job Posting Process

In a previous NewsBlast, USADWEB informed you that Indiana had begun requiring employers to register directly with the State Workforce Agency (SWA) and to pay an annual subscription fee of $50. Recently IN changed its posting procedure to mirror that of other states, such as Florida and Virginia.

IN no longer requires a $50 annual fee in order to post job orders, and employers and their designated agents can now register and post job orders directly online at www.indianacareerconnect.com. This change simplifies the registration process immensely, and job orders can post as soon as the registration is approved. This also allows USADWEB to post your clients' SWA job orders.
